ANAC approves temporary rules for air operations in isolated areas of the Legal Amazon

Another action that contributes to air transport during the pandemic caused by Covid-19 was approved by the Collegiate Board of the National Civil Aviation Agency (ANAC), this Tuesday (01/06).

The norm, which is part of the Simple Flight Program, temporarily allows aircraft to take off and land in uned locations located in the Legal Amazon.

With the new specific rules, humanitarian assistance to the communities in this region, including the emergency transport of medicines, inputs, vaccines and patients, will be able to be carried out more quickly, since the isolated areas have access restrictions by land or river.

With the Covid-19 pandemic, these locations have come to depend even more on air transport as one of the main means of emergency transportation.

The proposal is an alternative regulatory approach allowing, during the pandemic, air transport in uned areas, which, as a rule, is prohibited. For this reason, operations must be restricted to areas located in the Legal Amazon and exclusively to serve isolated communities, where travel by ordinary means of transport does not guarantee the necessary speed to carry out actions such as emergency removal of patients, delivery of medication or supplies and mobilization of health teams.

In addition, these operations may be used to carry out technical studies aimed at ing the runways with ANAC, in the search for a permanent solution to the access problem in these locations.

The regulation, which will come into effect this month, also promotes the promotion of regional aviation, access to health, for security operations and uniformity of treatment throughout the national territory, as recommended by the Brazilian Aeronautical Code - Click on the link to access.

To ensure the safety and purpose of these operations, the new rules are applicable to operators certified under Brazilian Civil Aviation regulations. RBAC No. 119, which establishes rules for public air transport operations of engers, cargo or mail, regular or non-regular, domestic or international, and RBAC No. 135, which regulates and authorizes public air transport operations with planes of up to 19 seats or helicopters. (click on the links to access)

Minimum requirements have been established for certified air operators. The rule also provides for the need for federal, state or municipal public bodies contracting the flights to sign a prior commitment term with ANAC.

In April 2020, ANAC also published an amendment to the annexes of the Ordinance No. 3.352/2018 (click on the link to access), which simplified the rules for regularizing existing private runways in the Legal Amazon region, without the need for them to go through the Agency’s construction authorization process.
