The Brazilian Institute for the Defense of Consumers and Workers (Abradecont), under the legal advice of Leonardo Amarante Advogados, filed a collective action, at the 21st Federal Court of São Paulo, against the Union, Infraero, Anac, the new concessionaire of Congonhas Airport and Supermix Concreto SA, owner of the jet that caused air chaos in October 2022, causing more than 300 canceled flights.
For the damage caused to consumers, the Abradecont Institute requests the payment of BRL 50 million in individual and collective compensation, as well as the condemnation of the defendants to carry out necessary measures to improve infrastructure and security at the Airport.
According to Leonardo Amarante, specialist in Consumer Law and collective actions, technicians have been warning about issues on the airport's landing strips for years. “Another important point is that the airport is located in a delicate area, within the urban perimeter, in a region of high population density and with no escape area. This means that the entire area surrounding the airport is exposed to the high flow of landings and takeoffs”, he points out.
The lawyer also warns of sharing the main runway with executive aviation companies. “We must ask what are the priorities currently in the public interest: a private jet that fits six people or the thousands of consumers that travel by different commercial airlines? This lane-sharing dynamic harms most consumers”, reinforces the specialist.
Finally, the expert points to the fact that the new concessionaire, a Spanish company whose term of concession with the Federal Government was published in March, will face major challenges in dealing with precarious infrastructure issues and the jet lobby. "In the new company's plan there is a forecast for the expansion of the airport, but also an increase in the number of flights, which means that they will exchange "six for half a dozen" and the consumer will continue to be harmed", he warns.
