Senate postpones decision on applying tax on aircraft leasing

The president of the Senate, Rodrigo Pacheco, informed during a session this Thursday (12) that the Provisional Measure of the airline sector (MP 1.094/2021) will only be voted on next week.

The matter, which was on the voting agenda this Thursday (12), provides for exemption from Withholding Income Tax (IRRF) for payments of lease (lease) of aircraft by Brazilian companies to foreign companies. The MP needs to be voted on by June 1st or it will lose its validity.

According to the text, the tax reduction is valid until the end of 2026. For 2022 and 2023, the rule reduces the rate from 15% to zero. As for 2024, the measure provides for a rate of 1%; 2% for 2025 and 3% for 2026.

According to the federal government's justification, the change will benefit companies in the regular enger or cargo air transport sector.

When editing the MP, the Executive argued that the 15% rate resulted in negative effects on tourism operations, generating increased costs and making it difficult for the sector to recover in the context of the pandemic. With the measure, the government says it hopes to lower travel costs and encourage tourism.
