ABEAR integrates ANAC workshop on judicialization in the airline sector

The president of the Brazilian Association of Airlines (ABEAR), Jurema Monteiro, participated this Wednesday (26) in the “Reduction of Judicialization” workshop, promoted by the National Civil Aviation Agency (ANAC) to discuss solutions to reduce litigation in the sector air. The event was held in the auditorium of the Ministry of Ports and Airports (MPOR) and was attended by representatives from the International Air Transport Association (IATA), the Latin American and Caribbean Transport Association (ALTA), MPOR and the associated companies GOL and LATAM, in addition to Azul and foreign airlines.

Jurema Monteiro participated in the opening of the event and highlighted the importance of the debate and the challenges of the topic. “I congratulate ANAC for this initiative because it is through events like this that we are able to take important steps. Brazilian air transport has quality service, we have positive indicators and we show progress year after year. There are gaps, but they do not justify these amounts spent annually by national and international airlines here in Brazil”, said the president of ABEAR.

ANAC's Consumer Relations Regulation manager, Yuri Cherman, spoke about the importance of raising consumer awareness on the topic and expanding communication actions. “Brazilians start from the premise that the service is poorly provided, an idea rooted in the population. There is also a lack of knowledge about Consumidor.gov: the entire sector s it, but a large part of the population still doesn't know about it. These are some examples of fronts that we need to face,” he said.

The director of MPOR, Júlia Lopes, highlighted the importance of the topic for the ministry and the National Civil Aviation Secretariat (SAC). “When the minister (Silvio Costa Filho) was sworn in, he became aware of the issue in the first days of his ministry. Judicialization is becoming a priority topic at SAC. We want to build an action plan to equip the ministry in its conversations and actions,” she stated.

For the director of External Relations at IATA in Brazil, Marcelo Pedroso, the consumer of air services has atypical consumption behavior. “In our sector, the majority of engers go straight to court. If your refrigerator breaks down, you will first look for the store where you bought it. Secondly, the manufacturer. Only later, with the problem unresolved, does the consumer usually take legal action. Unfortunately this does not happen in our segment”, he highlighted.

Paulo Costa, legal and regulatory director at ALTA, warned about the disparities observed with judicialization. “It is unbelievable to think that the money spent on legal actions could be greater than the earnings of an airline. It is a topic to be attacked, rest assured. We need to raise awareness across society,” he said.

After the opening, the second part of the event was dedicated to conversations, search for solutions and analysis of cases experienced in the airline sector, with the participation of representatives of the entities and employees of the airlines. The topics of this debate will be discussed at a new ANAC meeting with a date to be defined.
