On August 27, the National Civil Aviation Agency (ANAC) and the Swiss Civil Aviation Authority (FOCA) signed a Memorandum of Understanding that recognizes and gives validity to the Bilateral Agreement signed between Brazil and the European Union in 2010. Similar agreement The Memorandum of Understanding was signed between ANAC and the Norwegian Civil Aviation Authority (CAA NO) on January 29 of this year.
The agreements facilitate import and export activities of aeronautical products and the provision of technical assistance between civil aviation authorities for continued airworthiness issues of aircraft in operation.
The two also favor maintenance activities for Brazilian aircraft in maintenance organizations in Norway and Switzerland and recognition of approvals of technical data of aircraft in operation. Reciprocally, these agreements make it possible for Brazilian maintenance organizations to provide services to Norwegian and Swiss aircraft.
It should be noted that the g of the agreement with Norway resulted in the termination and replacement of the istrative Arrangement signed in 2003 by the Civil Aviation Department of the Centro Técnico Aeroespacial do Brasil (DAC) and the Civil Aviation Authority of Norway. This istrative Arrangement was entered into before the creation of ANAC and the insertion of Norway in the system European Union on Civil Aviation Safety (EASA) and was restricted to aeronautical product certification activities and between authorities for continued airworthiness of aircraft produced by Embraer.
Due to significant changes in the civil aviation systems of both States, the istrative Arrangement has become impractical and obsolete, requiring its replacement by an updated mechanism compatible with the civil aviation systems in force in Brazil and Norway.
Agreement between Brazil and the European Union
Since 2010, Brazil has maintained the “Agreement between the Government of the Federative Republic of Brazil and the European Union on Civil Aviation Safety” with the European Union. This is a Bilateral Agreement aimed at civil aviation safety and has two annexes: “Annex A – Procedures for certification of civil aeronautical products” and “Annex B – Maintenance procedures”.
These annexes present general, high-level procedures that must be implemented by the civil aviation authorities of Brazil and the European Union.
Complementary to the Agreement, there are also two technical documents developed by ANAC and EASA with the purpose of implementing the of Annexes A and B of the Agreement, called “Technical Implementation Procedures – TIP”(referring to Annex A) and the “Maintenance Annex Guidance – MAG” (Refer to Annex B).
Although both Norway and Switzerland are not of the European Union, the two countries are part of the European Economic Area Agreement (EEA Agreement). As such, they are subject to civil aviation legislation issued by the European Commission and submitted to the civil aviation system managed by EASA. Like all EU countries, Norway and Switzerland have two aviation authorities – EASA and CAA-NO in Norway, and EASA and FOCA in Switzerland.
