Historically, when the National Civil Aviation Agency (ANAC) carried out visits to an airport within its inspection planning, the operator received an invoice with an amount charged for the inspection. That is, even if there was nothing non-standard, there was a need for payment. With the new Civil Aviation Inspection Fee (TFAC) table, this distortion was suppressed and the amount paid by operators is now always related to services provided by the Agency.
It was following the commitment to simplify and modernize civil aviation – premises of the Simple Flight Program – that ANAC updated the TFAC table, creating new investment opportunities, cost reduction and more rationality for the airline industry (click on the link to access ). With the new table, TFACs for airport inspections and inspections at airlines – civil aviation security, for example, are no longer charged.
In the sphere of inspection, previously, the regulated was subject to the payment of the TFAC whenever ANAC carried out an inspection action in loco. Now, in an important advance that benefits regulated entities, the Agency has removed the charge for “Airport Inspection” fees, which ranged from R$1.364,20 to R$45.730,71, depending on the class of airport operator, and the of “Inspection of airline companies – civil aviation security”, which ranged from R$ 6.376,27 to R$ 12.752,54.
private airfields
With the aim of restricting the collection of TFAC to more complex cases, as well as adjusting and updating values, the new table revoked the fee of BRL 341,20 for authorization to build a private aerodrome or helipad, a service no longer provided by the Agency. , and changed several others, such as the fee for ing private aerodromes, reduced from BRL 1.364,20 to BRL 500,00, and setting the TFAC fee at BRL 2.000,00 for ing for a helipad, given the complexity of the process.
The fee for altering registration (modification of physical characteristics), which was BRL 341,35 and applied to any alteration of characteristics, will now apply to a smaller number of situations – only when it involves more complex alterations.
The TFAC for night operations at airfields or at a private helipad at ground level, for example, was fixed at R$ 500,00, the same amount charged for increasing the dimensions of the landing and takeoff runway or increasing the dimensions of the landing areas in Private helipad at ground level.
In case of registration alteration of a private elevated helipad that requires an increase in the dimensions of the landing areas or destined to make night operations feasible, the fee is BRL 2. The registration renewal fee went from R$409,41 to R$500,00.
public airfields
Adjustments to the registration of public aerodromes began to balance the efforts employed in each specific process. The aerodrome registration involved the payment of a TFAC of R$ 4.911,12 and another of R$ 1.364,20. Now, in a simplification, the fee will be a single one, from BRL 2 to BRL 15, applicable depending on the complexity of the intended homologation.
For cadastral registration, enabling daytime VFR approaches, or cadastral alteration at public aerodromes resulting from the construction of a new area for final approach and take-off of helicopters, for example, the TFAC was set at R$ 2. As for enrollment or registration change of more demanding approximations, such as IFR precision approximation (PA), the TFAC is R$ 15.
Important for the safety of operations, especially in the largest airports in the country, operational certification underwent a significant change. Consolidated in 2009, with the publication of the Brazilian Civil Aviation Regulation (RBAC) nº 139, this process remained without taxation for years, despite its relevance and complexity, as it is not included in Law nº 11.182, of September 27, 2005, which created the ANAC.
Now, on the operational certification of airports, a single TFAC is levied, with a value between R$ 10 thousand and R$ 25 thousand, charged according to the operator's class. And, if the airport operator has to make changes to the registration within the certification process, registration change fees will no longer be charged.
AVSEC certification
There were also relevant changes in relation to the AVSEC certification, with the forecast of new TFACs related to the approval of Civil Aviation Security programs against Acts of Illicit Interference. The measure seeks to reflect the relevance of these certification processes, which consist of extensive and careful technical analyzes and are intended to ensure that aerodrome and air operators establish, implement and maintain an appropriate safety program to comply with the requirements of the national AVSEC regulation. and International Civil Aviation Organization (ICAO) requirements and guidelines.
Ranges of TFAC values were established, according to the complexity of the analysis, referring to the approval of the AVSEC program. ANAC regulation provides for the applicability of four fees to airport operators, ranging from R$1 for the simplest cases, to R$10 for more complex analyses; and two fees for air operators, with values of R$ 1 thousand and 2 thousand. Smaller aerodrome and air operators will fit into the lowest TFAC values.
