The second instance of the Labor Court accepted the request for provisional relief made by the SNA to determine that Azul Linhas Aéreas initiate, within 30 working days (from the notification) the payment of the time on the ground between flight stages, based on the criteria used for flight time compensation.
In September 2021, the court had already upheld the decision of the first instance that condemned Azul to pay these amounts, in a collective action filed by the SNA.
The provisional guardianship decision for the payment of time on the ground is valid until the date on which the payment criteria for this amount are established, in collective negotiation, in common agreement with the union, pursuant to art. 57 of Law 13.475/2017.
The company was ordered to pay ground time between flight stages as a variable and separate portion of the base salary, in the amount of 80% of the “flight hour”.
In addition, as claimed by the SNA, the decision to compensate the remuneration for time on the ground with the amount called “compensation for hours on land” for employees who ed the company until April 2013 was excluded from the sentence.
A request from Azul to relegate the setting of interest rates and monetary restatement to the judgment settlement phase was also accepted.
