The mixed commission that analyzes Provisional Measure (MP) 863/18 postponed until Thursday (11/04), at 09:30 am, the vote on the report on the matter, which raises the foreign capital limit from 20% to 100% in Brazilian airline industry.
Voting was suspended due to a request for a review submitted by Senator Jean Paul Prates (PT-RN) and Senator Zenaide Maia (Pros-RN), contrary to the Executive's proposal. The term of validity of the MP expires on May 22.
Rapporteur for the measure, Senator Roberto Rocha (PSDB-MA), in favor of opening the airline sector to foreign capital, rejected all 21 amendments presented to the text. He just presented a wording amendment that, according to him, meets the request of representatives of aeronauts, with whom he has been meeting in recent days.
Thus, according to Rocha, international flights operated by Brazilian companies must have national crew, through an employment contract governed by Brazilian law, except for the possibility of a maximum of 1/3 of foreign flight attendants. “We have to open up Brazil. This xenophobia no longer fits”, stated the rapporteur.
Zenaide Maia, in turn, recognized that Brazil must open the airline sector to foreign capital, but questioned the percentage of 100% of the shareholding of a company, since "in the United States, it is 25%, as well as in the countries of the European Union”. Jean Paul Prates also recognized the importance of the proposal, but he stressed that the Chamber is still discussing proposals with a related theme.

Last month, the plenary of the Chamber approved a similar project (PL 2724/15). The text allows the share capital of airlines headquartered in Brazil to be completely foreign. Australia, New Zealand and the European Union also it 100% foreign capital for companies that operate only within their territory. This proposal awaits a vote in the Senate.
