Resolution No. 457, of December 20, 2017, which regulates istrative measures for the use of the Logbook (DB), is submitted to Public Consultation No. 11/2022, for a period of 45 days, from July 18 to 1 of September.
The objective is to bring to interested parties and society in general the discussion of the proposal that seeks to establish proportionality and effectiveness to the sanctions applied for non-compliance with rules related to filling out the DB.
In the public consultation proposal, changes are suggested in the wording of the current rules with the aim of simplifying the normative action of the National Civil Aviation Agency (ANAC), both by removing duplications and repetitions of commands, as well as by excluding obligations that do not add value to the Logbook or it other means of compliance.
In general, Resolution No. 457 applies to a multitude of regulated and professional entities, with istrative measures being applied indistinctly, regardless of the criticality of the registration in the DB.
Today, the values are the same for all regulated (operators, pilots in command, responsible for recording maintenance actions) and without distinction by size or type of operation (private operations, Specialized Air Service or transport under the Brazilian Aviation Regulations Civil No. 135 and No. 121).
Encouraging a collaborative posture
In addition to improving the current model of enforcement established, the Agency's objective is to incorporate into the norm alternative mechanisms to encourage the adoption of a collaborative posture by the regulated and, at the same time, reinforce measures of constraint to agents who, through the manipulation of records in the Logbook, for example, seek to reduce their aircraft maintenance costs.
In order to arrive at the proposal now submitted for public consultation, a Regulatory Impact Analysis (AIR) was carried out with the detailing of the theme within the scope of the International Civil Aviation Organization (ICAO) and in Brazilian regulations, in addition to identifying the problems arising from the current regulatory framework.
