The SNA warns the category of pilots and flight attendants and calls for special attention from federal deputies and senators to a proposed amendment presented to Provisional Measure No. and jeopardizes flight safety throughout the country.
Proposed amendment 77, authored by Deputy Sanderson (PSL-RS), would allow Brazilian companies to lease aircraft already with crew, regardless of nationality.

If approved, the amendment could pave the way for unrestricted outsourcing, creation of “virtual” companies, precariousness of services, difficulties in inspection and tax collection by the government, unfair competition in the sector and damage to the regulation of the profession of pilots and flight attendants. —also contributing to possible impacts on flight safety for everyone.
According to the text suggested by the deputy, it would be allowed that a Brazilian company, operating with a foreign registration plane in the exchange format, would not need to have Brazilian crew .
that the three major Brazilian airlines are part of large international conglomerates. Therefore, this rule would be easily used by any of them.
The SNA understands that the proposed amendment is an affront to Brazil's sovereignty and that it could bring harmful results to society.
At the limit, a company could create a CNPJ, hire outsourced employees at airports and lease foreign aircraft already with crew. In other words, the legalization of cabotage —when foreign companies carry out domestic routes— would be disastrous for the country.
A company along these lines could easily break down and abruptly interrupt its provision of services.
It is worth ing that we had in Brazil the recent case of Itapemirim, which stopped its activities in less than a year, failing to fulfill obligations with thousands of consumers and employees.
Under these conditions, these companies may also represent unfair competition against their competitors, taking advantage of the precariousness of services and professionals.
It is also important to highlight that pilots and flight attendants need to follow specific rules and regulations, with constant and continuous training, in addition to frequent evaluations.
Enforcement and compliance with this would be difficult in a company where the crew are foreigners, hired under the law of their countries of origin —which would have a direct impact on the guarantees of safety in operations.
MP 1.089 was published on December 30, 2021 and is in effect until June 1 (the 120-day period was extended due to the parliamentary recess), and must be voted on by the National Congress so as not to lose its validity and be converted into law.
The SNA calls for the awareness of parliamentarians and the mobilization of the category so that amendments and articles with the potential to harm national aviation are not approved, especially amendment 77.
