The Federal Court of s (TCU) suspended the amendment to the concession contract between GRU Airport, concessionaire of Guarulhos International Airport, and the National Civil Aviation Agency (Anac), signed on the 6th, for building the Automated People Mover (APM). The APM is a type of elevated train that would transport engers between the three airport terminals and the 13-Jade line of the Companhia Paulista de Trens Metropolitanos (TM). Currently, this transfer needs to be done by bus.
According to Minister Vital do Rêgo, rapporteur for the case, the TCU was informed of the signature of the amendment on the 3rd, and the signature took place only three days later, on the 6th. three days, whose formalization depends on the evaluation of this TCU regarding documentation that proves the viability of the undertaking, without waiting for the manifestation of this Plenary, sounds, to say the least, imprudent”, said the rapporteur in the suspension decision.
“I understand that this project may have relevance and priority, but nothing justifies this trampling and the total lack of transparency on the part of those involved”, said in the dispatch signed yesterday (15).
In the decision, the TCU gave 15 days for the Ministry of Infrastructure and Anac to comment on the lack of comparative studies with other transport systems that could be implemented in the area. He also asked for the demonstration of the pre-feasibility stage and the reach of the public interest to guide the choice of the APM system.
The reporting minister also requested that the results of the analysis of the new price proposals of the companies selected for the implementation of the project be presented, any changes to the risk matrix, as well as the impacts on the economic and financial rebalancing of the concession contract signed with the GRU Airport.
In a note, ANAC said that it always acts in collaboration with external control bodies and will provide all necessary information and clarifications to the TCU.
“It should be noted that ANAC, striving for transparency, has been informing the Court of each stage of the process, from the beginning of the negotiations between the Federal Government and the State of São Paulo, in 2019, until the amendment approved on the last day 06/09 .”
The Ministry of Infrastructure (Minfra) said, in a note, that it operates in full collaboration with the control bodies and will provide all clarifications and information required by the TCU. “The ministry understands that the largest airport in South America deserves the people move, which will bring greater convenience and safety to engers”.
